The department is governed by the Kansas State Board of Education, but the day-to-day administration of the agency is the responsibility of the Commissioner of Education, who is appointed by the Board of Education.

Position Summary & Responsibilities:
This position serves as the General Counsel for the Kansas State Department of Education (KSDE). The Office of General Counsel provides legal counsel and advice in response to questions asked by agency staff and provides information to local education officials and the public. In addition, the General Counsel's office serves as legal counsel for the Professional Practices Commission (PPC), the group charged with making recommendations to the Kansas State Board of Education (KSBE) regarding the denial or revocation of teaching licenses; and serves as hearing officer in land transfer matters. The General Counsel also oversees the drafting of contracts for the agency and writing and/or editing proposed rules and regulations for the agency.

Required Minimum Qualifications:
Juris Doctorate from an accredited school of law. Certificate of admission to the Bar of the Supreme Court of Kansas, or temporary permit to practice law issued by the Supreme Court of Kansas and five years of experience practicing law as a licensed attorney.
Preferred Skills and/or Qualifications:
Knowledge of common law and of the state and federal laws, particularly in regard to general administrative and regulatory functions of state government;
Knowledge of judicial procedures and the rules of evidence;
Knowledge of the principles, methods, materials and practices of legal research;
Knowledge of the methods and practices of pleading and presenting civil and criminal cases;
Knowledge of federal and state laws and regulations affecting the administration education;
Knowledge of the principles and practices of supervision;
Ability to plan, assign and review the work of subordinate attorneys and clerical employees;
Knowledge of principles, practices, theories and trends in general education law, contract law, constitutional law, employment law, civil procedure, administrative procedure, federal education and special education law, federal discrimination law, state and federal regulatory law;
Demonstrated communication skills including the ability to write legal memorandum, pleadings, briefs and contracts; the ability to speak effectively before groups and the public; and the ability to interact with attorneys, government officials, court officials, parents, students, education professionals, administrative officials and fellow employees;
Ability to work independently and prioritize a broad range of frequently changing circumstances, conditions, problems, activities, methods, programs and interactions;
Computer literacy regarding legal research, word processing, email, internet functions and calendaring; and
Team work skills and effective interpersonal skills.
Preferred Experience:
Experience with education law, contract law, constitutional law, employment law and administrative procedure.
Necessary Special Qualifications, Licenses, Certifications, and/or Registration:
Certificate of admission to the Bar of the Supreme Court of Kansas.
